ALDOR Seeks Submissions for New ENDS Directory

Submissions Accepted Beginning March 1, Directory to Launch May 1

MONTGOMERY – The Alabama Department of Revenue (ALDOR) is developing a directory of Electronic Nicotine Delivery System (ENDS) manufacturers and products that will be allowed for sale in Alabama as required by Act 2021-453.

Beginning March 1, 2022, every e-liquid manufacturer and manufacturer of alternative nicotine products must present a certification along with other requirements to ALDOR showing where the manufacturer either received a marketing order from the Food and Drug Administration (FDA) or the manufacturer submitted a premarket tobacco product application on or before Sept. 9, 2020, to the FDA; and, the FDA issued either a stay order or injunction pending appeal of a no marketing order or notification that the products remain under review.

ALDOR is required to develop and maintain the directory of ENDS manufacturers and their products approved for sale in Alabama. Beginning May 1, 2022, ENDS products not listed on the directory cannot be offered for sale in this state, and manufacturers and retailers are subject to a daily penalty for sales of products not listed on the directory.

In addition, Act 2021-453 imposes additional restrictions on the marketing of certain nicotine products.
