SUBJECT: Legislative Changes
As a follow up to the Rebuild Alabama Act Memo (https://revenue.alabama.gov/news/memo-rebuild-alabama-act/), the following fuel types are now required to be included in the motor vehicle registration record (except trailers):
G – Gas D – Diesel E – Electric H – Hybrid | P – Plug-in C – CNG L – LNG O – Other |
In addition, the AGO has provided a legal opinion (https://www.alabamaag.gov/Documents/opin/2020-005.pdf) on the distribution of funds collected pursuant to the Rebuild Alabama Act.
A subcommittee of Legislative Oversight Committee on License Plates has determined which distinctive license plates are subject to the Opt-In/Out provisions of Act 2018-005. Additionally, several other changes have been made to registration validation edits to resolve issues reflected in the registration error report.
Legislative Act 2019-305 (effective August 1, 2019), amends Section 32-6-67, Code of Ala. 1975, to allow for personalized license plates denied issuance or revoked by the department to be appealed with the circuit court of the county where the motor vehicle is registered.
Legislative Act 2019-238 (effective October 1, 2019), amends Sections 32-8-2 and 32-8-34, Code of Ala. 1975, to allow for title service providers to become agents for designated agents and lien-holders. A title service provider is a person who is bonded and authorized by the department to act as an agent on behalf of: a licensed dealer, lienholder, or other designated agent. Furthermore, the law also prohibits dealers appointed as designated agents from processing title applications on behalf of another dealer unless both dealerships are owned by the same entity. Anyone, that is not a title service provider, and completing title applications on behalf of a licensed dealer/designated agent should complete an application to become a title service provider. The Motor Vehicle Division should be notified if your office is aware of anyone in your county that is acting as a unregistered title service provider.
